1835 Slave Named Tolley Arrest Warrant at Lynchburg, VA. Noted on the Reverse “Give Tolley Twenty Lashes.”

February 16, 1835-Dated, Partly-Printed Arrest Warrant for a Slave Named “Tolley”, Lynchburg, Virginia, Very Fine.

This Document has been filled out by hand and measures 4-1/4” x 7-3/8”. This unusual document reads, in part: “Whereas complaint has been made to me, Lindsey Shumaker, a Justice of the peace... on the oath of Nancy Lynch a Slave, that... Tolley, a Slave the Property of Collier Buckner did make an affray by entering the house of the above named Nancy Lynch as well as by upsetting and beating her, the s[aid] Lynch...” In a dark turn, the back is docketed with the notation: “Give Tolley Twenty Lashes.” In generally good condition, with some soiling on the back, especially around the docketing. What is unusual about this document is that the Justice of the Peace relied on an Oath made by a Slave, something that was not normally recognized in courts at that time.
